C-001 BY ADDING SECTION 91-A CREATING THE CITY ECOLOGICAL SOLID WASTE MANAGEMENT BOARD (CESWAMB) THEREOF (Sponsored by HON. NERIO G. ZAMORA, City Councilor) WHEREAS, the City Government of Tagbilaran is aware of the need for the maintenance of a well-balanced and healthful ecology; WHEREAS, in its commitment to address the pressing problems on solid waste to protect and preserve the environment, the City has defined measures to reduce the volume of solid waste generated; WHEREAS, the creation of the City Ecological Solid Waste Management Board merits support and cooperation for a zero waste management scheme for the welfare of the City of Tagbilaran; WHEREAS, this is in compliance with Republic Act No. 9003 otherwise known as the Ecological Solid Waste Management Act of 2000; NOW THEREFORE, Be It Ordained by the Ninth Sangguniang Panlungsod of the City of Tagbilaran in session duly assembled that: SECTION 1. Article VIII, Chapter XV (Environmental Management Code) of Ordinance No. C-001 is hereby amended by adding Section 91-A thereof to read as follows: (a) Creation and Composition. – There shall be created an Ecological Solid Waste Management Board of the City of Tagbilaran which shall be composed of the following: Chairperson: City Mayor Vice Chairperson: SP Chairperson, Committee on Environmental Protection and Development Members: 1. President, Liga ng mga Barangay; 2. President, SK Federation; 3. At least three (3) representatives from accredited Non-Government Organizations, People’s Organizations, and Private Associations with Environmental Concerns; 4. Representative, City Scrap and Iron Buyers; 5. Representative from Industrial Sectors; and 6. Representative, Department of Science and Technology (DOST). (b) Powers and Functions.- The Board shall exercise the following powers and functions, but not limited to: 1. Formulate plans and programs on zero waste management; (P.O. No. 31-04) -page two- 2. Lead in the implementation of the waste segregation and minimization scheme as well as for the formulation of programs for the enforcement and implementation of R.A. 9003; 3. Exercise such other powers and functions, as may be conferred by the Sangguniang Panlungsod. (c) The Board shall hold its regular meeting at least once in every quarter. Special meetings may be called as the need arises upon the discretion of the chairperson. SECTION 2. This ordinance shall take effect upon approval. ENACTED, September 8, 2004.
